L'auteur confronte les thèses du philosophe Jean-Marc Ferry dans La question de l'État européen aux notions juridiques d'État, de fédéralisme et de Constitution. Après avoir souligné l'originalité de ces thèses dans le débat actuel sur la constitu-tionnalisation de l'Europe, il analyse le concept d'« État européen post-national » construit par Ferry. Il montre ensuite la pertinence de la théorie défendue par Olivier Beaud selon laquelle l'Union européenne relève d'une catégorie tierce qui n'est ni celle de l'État fédéral ni celle de la confédération d'États : la « Fédération plurinationale ». Il apparaît alors que le concept philosophique d'« État post-national » est très proche de ce concept juridique de « Fédération plurinatio-nale ». The Issue of the European State from the Point of View of a Constitutionalist
The author confronts the theses of the philosopher Jean-Marc Ferry in La question de l’État européen with the legal notions of state, federalism and constitution. After having emphasized the originality of those theses in today’s political debate about the constitutionalization of Europe, he analyses the concept of « European post-national State » constructed by Ferry. Then he shows the relevance of the theory defended by Olivier Beaud, according to which the European Union is to be related to a third category, which is neither that of the federal state nor that of the confederation of states, but the « Plurinational Federation ». The philosophical concept of « post-national state » appears then to be very close to the legal notion of « Plurinational Federation ».
