La question de l’État européen, le juriste et la ruse de la construction communautaire

La question de l’État européen, au sens où elle est posée par Jean-Marc Ferry, évoque pour le juriste celle d’une « constitution » pour l’Europe. Ces deux ques-tions ne sont toutefois pas identiques, ne serait-ce que parce qu’elles relèvent de disciplines différentes. Quatre fils tissent la réflexion suggérée par l’auteur. D’une part, la distinction classique entre constitution matérielle et constitution formelle est revisitée. D’autre part, le développement de la Communauté de droit est repla-cé dans le contexte élargi des continuités et discontinuités qui ont partout caracté-risé les processus de transformation des États de droit en États sociaux.
The Issue of the European State, the Jurist and the Cunning of Community Construction
For jurists, the question of the European State, as presented by Jean-Marc Ferry, brings up that of a « constitution » for Europe. These two questions, however, are not identical if only because they belong to different disciplines. Four strands make up the thoughts suggested by the author. On the one hand, the classical distinction between material constitution and formal constitution is revisited. On the other hand, the development of the Community of Law is replaced in the enlarged context of the continuities and discontinuities that everywhere have characterised the processes of transformation of « l’État de droit » [rule of law] into a Social State.
