Sentiment d’injustice, lutte pour le droit et rationalité axiologique : variations sur le « cas » de Michael Kohlhaas

Dans cette relecture à visée sociologique de la nouvelle de Kleist, Michael Kohlhaas, l’auteur s’interroge sur la nature du sentiment d’injustice éprouvé par Kohlhaas et montre, avec l’aide du juriste von Jhering, que l’exigence de répa-ration ici posée s’inscrit dans une lutte pour le droit. Sur cette base, on peut établir que le cours d’action de Kohlhaas est ordonné à un principe – le réta-blissement dans ses droits – et relève par là de la rationalité axiologique. En-fin, le double visage du droit dans le cas de Kohlhaas – la réparation du dom-mage aux biens et la condamnation capitale pour trouble de l’ordre public – invite à évoquer la dimension proprement morale du sentiment de justice.
Sense of Injustice, Fight for One’s Rights and Axiological Rationality : Variations on the “Case” of Michael Kohlhaas
The present paper proposes a rereading of Kleist’s short story, Michael Kohlhaas, from a sociological perspective and questions the true nature of Kohlhaas’ feeling of injustice. With the help of the legal scholar von Jhering, the author shows that the demand for compensation here proceeds from a fight for justice. On this basis, it can be asserted that Kohlhaas’ actions are following some highly valued principle of justice – the recovery of his rights – and thus, fall within the domain of axiological rationality. Lastly, the two faces of law in Kohlhaas’ case – he obtains redress and yet is condemned to death for disturbing the peace – invite the evocation of the moral dimension of the common perception of justice.
