L’État, la frontière et l’étranger « indélicat »

Il est aujourd’hui impossible d’aborder les questions de l’immigration et du droit d’asile sans faire référence aux « dysfonctionnements » institutionnels et juridiques de l’Union européenne. La solution la plus fréquemment avancée avec conviction résiderait dans une « harmonisation » européenne des politiques migratoires. Cet enjeu existe mais il nous semble subordonné à une croyance fondamentale qui est celle d’une vision de l’ordre national et de sa sécurité symbolique déterminant une hiérarchie des impératifs catégoriques : ce qui doit être défendu, ce n’est pas tant l’intégrité physique du territoire de la nation (qui n’est objectivement menacée par personne) que la société contre une menace d’anomie.
State, Border, and the « Rude » Foreigner
It is nowadays impossible to tackle the issues of immigration and of asylum rights without referring to the institutional and legal « malfunctionings » of the European Union. The solution most often put forth with sincere belief would consist in a European « harmonization » of migration policies. Although the issue does exist, it seems to be subordinated to the fundamental belief in national order and symbolic security as determined by a hierarchy of categorical imperatives. What must be defended is not so much the physical integrity of the territory of the nation (which is not objectively threatened by anybody). It is a threat of anomie in society.
